Las Vegas Office Prevails on Appeal of District Court's Grant of Summary Judgment in Favor of Clients

The Las Vegas office received affirmation from the Nevada Supreme Court of the District Court's grant of summary judgment in favor of clients in a complex case involving, among other issues, the question of whether a pharmacy may be held liable to a customer for his overdose where it is undisputed that the pharmacy dispensed the medication in accord with a valid prescription. Using the newly adopted learned-intermediary doctrine, the Nevada Supreme Court reaffirmed the notion that pharmacists do not have a duty to warn a customer of generalized risks inherent in a prescribed medication.
