San Francisco Office Prevails on Motion for Summary Judgment in Serious Personal Injury Case Against Retail Store

Robert K. Phillips, Brenda H. Entzminger, and Lincoln Tran brought a Motion for Summary Judgment against Plaintiff who alleged serious personal injury when she was stuck by an electric shopping cart operated by a third party in a retail store. Plaintiff sought over $250,000.00 against the retail store in medical expenses and wage loss damages allegedly related to the incident.

On April 7, 2011, the Court heard oral argument on behalf of the defendant retail store’s Motion for Summary Judgment. The trial court for the Superior Court of Santa Clara County held that defendant had presented sufficient evidence to demonstrate that the injury at issue was unforseeable.

The trial court thus granted Defendant’s Motion for Summary Judgment and the entire case was dismissed.
