Firm Prevails on Motion for Summary Judgment in Nevada District Court Wrongful Termination Case
On October 15, 2009, Gregory L. Spallas and Shivani Sutaria prevailed on a motion for summary judgment and obtained dismissal of a lawsuit against a firm client in which Plaintiff alleged sexual orientation discrimination and retaliation. The case, venued in the United States District Court, District of Nevada, included claims for front and back pay, emotional distress and punitive damages. The court agreed with the arguments in the Motion that Plaintiff was lawfully terminated for reasons which did not involve his sexual orientation and that he did not engage in a legally recognized protected activity for which he was subjected to retaliation.
