Las Vegas Obtains Defense Verdict at Arbitration in Premises Liability Lawsuit

Congratulations to our Las Vegas office for obtaining a defense verdict in a premises liability lawsuit brought against a Fortune 500 retailer. The plaintiff alleged negligence after a pallet being pulled by a store associate allegedly hit her. The arbitrator found plaintiff was walking backwards at the time of the incident, did not look behind her before backing up, and saw a store associate pulling a similar pallet prior to the incident. The arbitrator concluded that plaintiff’s negligence was more than 50% based the open and obvious nature of the hazard and awarded a defense verdict.
