Nevada Office Obtains Summary Judgment in Premises Liability Case

Las Vegas associate Ryan Kerbow obtained summary judgment in a premises liability slip and fall matter. Plaintiff slipped and fell on orange soda in a store. Approximately twenty seconds prior, a female customer pushing a shopping cart and accompanied by a small child stopped momentarily in the spot where the incident would occur, then turned the cart and proceeded down an aisle. This matched the path of the orange soda as described by the store employee who wiped the spill. We argued the child caused the spill. Plaintiff alleged injuries to her left wrist, right wrist, left knee, and back and claimed she would have to undergo a knee replacement.  The court found no evidence of causation or notice to create a genuine issue of disputed fact.
