San Francisco Office Prevails on Motion for Summary Judgment in Wrongful Death Suit

Attorneys Todd Angstadt and Elisa Marcaletti successfully obtained a dismissal of a wrongful death case against all three of their clients. The plaintiffs sought general, special and punitive damages in the seven figure range for their son’s death following an altercation at a social gathering. Mr. Angstadt and Ms. Marcaletti filed a motion for summary judgment, arguing that their clients did not owe a duty of care to protect against unforeseeable criminal acts by a third party.  Alameda County Superior Court Judge Yvonne Gonzalez Rogers  agreed and granted the motion. Judge Rogers was recently appointed to the United States District Court for the Northern District of California by President Obama in November 2011. During the appointment process, Judge Rogers cited to this case as one of her 10 most significant decisions while on the bench in Alameda County.
