San Francisco Attorneys Win Motion for Summary Judgment for Contractor in Personal Injury/Products Liability Case
Congratulations to partner Alyce Tonon and associate Michelle Long for their recent Motion for Summary Judgment victory. Plaintiff was employed by a bulk liquids storage company at a southern California port. While working, a section of the property flooded, and the standing rainwater became heated. Plaintiff slipped on a submerged metal trench plate and sustained burn injuries. Ms. Tonon and Ms. Long represented a contractor who completed pipe insulating work on a product line. Plaintiff alleged that the contractor was liable because the contractor’s insulation installation failed and that the contractor should have insulated a steam line, that caused the heated water. The Court agreed with our defense that our client did not owe a duty, plaintiff could not establish causation or existence of a defect, and that our client did not design/manufacture/supply the steam line or trench plate.
